The exact scope of any engagement is defined in a written quotation, work order, or service agreement. These Terms apply to all engagements unless expressly varied in writing.
3. Engagement and Quotation
Quotations are valid for the period stated on the quotation. Engagement commences only upon written acceptance of a quotation and any advance payment that may be required.
4. Client Obligations
You agree to:
- Provide accurate, complete, and timely information relevant to the assignment.
- Grant safe and reasonable site access where on-site inspection is required.
- Designate a single point of contact for the engagement.
- Pay invoices in accordance with the agreed terms.
- Comply with all applicable safety and regulatory requirements at the inspection or training venue.
5. Inspection Reports and Deliverables
Our inspection reports represent our independent professional assessment based on the observations and tests carried out on the date(s) of inspection, and within the scope agreed in writing. Reports are issued for the Client's use only and may not be relied upon by third parties without our prior written consent.
We do not warrant or guarantee the future performance, durability, or fitness-for-purpose of any item inspected, beyond the specific scope and method documented in the engagement.
6. Fees and Payment
- Fees are as set out in the quotation or agreement and are exclusive of applicable taxes (GST), travel, and out-of-pocket expenses unless expressly stated otherwise.
- Invoices are payable within the period specified on the invoice. Late payment may attract interest at the rate permitted by applicable law.
- Disputed invoices must be notified in writing within seven (7) days of receipt.
7. Intellectual Property
All content on this website (text, images, logos, design, code) is the property of Garvit Enterprises or its licensors and is protected by Indian and international copyright and trademark laws. You may view, download, and print extracts for personal or internal business use only. Any other use requires our prior written permission.
Inspection reports remain the intellectual property of Garvit Enterprises and are licensed to the Client for the agreed purpose, unless otherwise specified in writing.
8. Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other during the engagement and to use it only for the purpose of the engagement, except where disclosure is required by law or by a competent authority.
9. Limitation of Liability
To the maximum extent permitted by law:
- Our total aggregate liability arising out of or in connection with any engagement is limited to the fees paid by you for that specific engagement.
- We are not liable for indirect, incidental, special, consequential, or punitive losses, including loss of profit, loss of business, or loss of opportunity.
- Inspection findings are advisory; commercial decisions taken on the basis of our reports rest solely with the Client.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or gross negligence.
10. Indemnification
You agree to indemnify and hold Garvit Enterprises, its directors, employees, and authorised representatives harmless from any claim, loss, or expense (including reasonable legal costs) arising from (i) your misuse of our reports or website, (ii) inaccurate or misleading information provided by you, or (iii) your breach of these Terms.
11. Force Majeure
Neither party is liable for delays or failure in performance caused by events beyond reasonable control, including natural disasters, war, civil unrest, government action, strikes, pandemics, internet or power outages, or denial of site access.
12. Termination
Either party may terminate an engagement by written notice if the other party materially breaches these Terms and fails to remedy the breach within fifteen (15) days of written notice. Fees for work performed up to the date of termination remain payable.
